In June 2019 I knew that people would say that I deserved to have bleach thrown in my face because of my background. Two years later, when I was in settlement talks with the attorneys for the state who defend the actions of management who did nothing to help me be safe, I heard exactly what I predicted. The reason management offered for their inaction, was that I had provoked the tenant to assault me and I was looking for trouble so I got what I deserved. This argument has no legal validity since the state of Hawaii does not permit violence against another person due to provocation. In fact, self defense is limited to defending oneself only inside of one’s home when there is a direct threat, rather than allowing people to shoot someone who appears threatening in public. But the deputy attorney general, J.C. Jr., was not relying upon legal arguments but upon prejudice. He counted on the judge to agree that I got what I deserved and you know what? The judge has more or less been another representative for the state employees who did not do their jobs. The defense–we agree they did not do their jobs, but we say–so what? I knew when the assault happened that I was the one who had been baited to respond because if I had returned the assault you better believe I would have been locked up. However, I knew better than to hit someone back, no matter how tempting it would be. In Hawaii, if someone says you hit them, the police will arrest you and hold you for twelve hours and then release you without charging you, and that’s the best case scenario. I would not have stood a chance against someone who is from here, or lacking that, someone who is white. I knew it then, and i know it now. I have court today in less than 12 hours and I predict that the judge will rule I have to abide by the fraudulent settlement agreement no matter how it deviates from the agreement that was put on the record, and no matter that I had no hand in drafting the paperwork and was not allowed to make changes or have an attorney make changes. Yes, I sued management for failing to do anything about the assault shown in the above video. But no one cares. Bc everyone agrees with the tried and true statement that has worked for so many men and was applied to me, albeit in a different way than usual: I was asking for it.
